Witholding tax refund, 32 weeks pregnant and being sued?

My husband and I are being sued for some things that are our fault (such as witholding rent for damages in the home) and some things that arent ( such as the damages that were there when we moved in), We havent gotten a detailed list of charges but at this point im scared. We need our tax return not only to get new clothes for our daughter now but buy things for our baby due jan.27th. Our court date is set up for the 27th of december and Im so scared if we lose or have to pay a portion of the charges that theyll withold our tax return. I guess I have two questions one being if we get senteced dec.27th and we file at the beginning of the year could they withold our tax return or will they let us have it since wed still have time to pay it and since I got the call telling me the time and date its getting real, I was told I didnt have to go into the court room and could sit out in the hall being pregnant. is this true?
